WeldQ SCHEDULE
The following terms and conditions apply when Weld Australia ABN 63 003 696 526 (Weld) provides its customers (Customer, you) with examination and certification services available through the WeldQ site at https://app.weldq.com (Site).
The terms and conditions set out in this document (WeldQ Schedule) are in addition to Weld’s General Terms and Conditions available at https://weldaustralia.com.au/general-terms-and-conditions/ (GTC). If there is any inconsistency between the GTC and the WeldQ Schedule, the latter prevail over the former to the extent necessary to resolve the inconsistency.
All capitlised terms have the meaning given to them in the GTC unless otherwise defined in this document.
1. Access to the Site
1.1. Terms of use. Your access to the Site is conditional on your compliance with the WeldQ Schedule and the GTC.
1.2. Amendments. Weld may amend the WeldQ Schedule from time to time by posting the most recent terms on the Site. You must regularly review the latest version of the WeldQ Schedule, as it will be the terms upon which you access the Site at all times.
1.3. Linked Sites. The Site may contain links to third party websites, content or services (Linked Sites). Access to and use of Linked Sites is at your own risk and subject to the terms and conditions of the relevant third party. Weld is not responsible for, and makes no representations in relation to, any Linked Sites.
2. Information available from the Site
2.1. Reliance on information. You acknowledge and agree that Weld is entitled to rely on the accuracy and completeness of information that you upload to the Site.
2.2. Disclaimer. Your use of the Site is at your own risk. The Site is provided “as is” and “as available.” Weld does not guarantee that the Site will meet your requirements, be uninterrupted, secure, error-free, or that any results or products obtained through the Site will meet your expectations. Any material downloaded or obtained through the Site is at your own risk. No advice or information provided by Weld creates any warranty not expressly stated in the GTC. Weld, its employees, contractors, agents and licensors are not liable for any loss, damage, or costs arising from your use of the Site, inability to use the Site, reliance on content, transactions, unauthorized access, or the conduct of third parties.
3. Trademarks and Copyright
3.1. The Weld logo and service name are trademarks of Weld. You may not use or display the Weld logo and service name without prior written permission of Weld.
3.2. By using the Site, you grant Weld the right to store, use, reproduce, and disclose any information you provide (including data, text, photos, drawings, sound recordings, or feedback) in accordance with Weld’s Privacy Policy, including for marketing or other purposes specified in the policy.
4. Registration and email updates
4.1. WeldQ Account. When you register for a WeldQ account, you agree to submit true, accurate and complete information about yourself and to keep that information up to date.
4.2. Suspension. If Weld suspects that you have provided untrue, inaccurate or incomplete information, Weld may suspend or terminate your account and refuse any and all current or future use of the Site.
4.3. Email updates. You may receive emails from Weld about consultations you have participated in or topics of potential interest based on your activity on the Site. If you do not wish to receive these emails please contact office@weldaustralia.com.au.
5. Fees
5.1. Examination fees.
(a) When you apply for an examination in WeldQ, Weld will check your WeldQ account to determine whether you are eligible for the relevant examination and you will be advised of the applicable fees.
(b) Examination fees are payable upon confirmation of eligibility for examinations and are payable directly through WeldQ.
(c) Examination fees include one exam attempt; re-sits are payable separately via WeldQ.
(d) Examinations must be taken within 12 months of payment of fees; refunds may be requested for unallocated examinations within that period; if the 12 month period has elapsed, fees will not be refunded.
5.2. Cancelation and rescheduling examinations
(a) Examination fees will be refunded in full if Weld cancels an examination.
(b) Candidates may cancel an examination by written notice to Weld at qnc@weldaustralia.com.au. If the notice is received by Weld at least 15 days prior to the scheduled examination, the examination fee will be refunded in full or if the examination fee has not yet been paid, no fee is payable. If the notice is received less than 15 days prior to the scheduled examination, the examination fee will not be refunded and if the examination fee has not yet been paid, it will be due and payable in accordance with the payment terms in the GTC.
(c) Candidates may request to reschedule an examination by written notice to Weld at least 15 days before the examination. Rescheduling within 14 days of the examination is not permitted and the examination will be treated as cancelled and the full examination fee will be payable.
(d) For Institute of International Welding (IIW) courses, a candidate may reschedule an individual exam only once unless otherwise approved in writing by Weld.
5.3. Certification fees.
(a) Certification fees are payable upon submission of a certification application.
(b) Certification validity periods vary by type and are stated in the online course program.
(c) Certification fees are non-refundable.
6. Examinations
6.1. Examination process.
(a) Candidates must begin with Module 1 (or the first applicable module) unless an exemption is approved.
(b) Candidates seeking IIW qualifications have three years from their first exam to complete all modules.
(c) Exams (written, oral, practical) may be held after each module or at the end of the course. If taken at the end, the first exam must be attempted within three months of course completion. Exams may be taken in any order.
(d) Candidates who fail an exam may attempt up to two re-sits. The first re-sit must occur within 15 months of the failed attempt; otherwise, it is forfeited. Candidates who fail the final permitted re-sit must re-attend the training course for the failed module before reattempting.
(e) Candidates seeking welder qualifications must meet the requirements of AS/NZS ISO 9606. The specific requirements are detailed in each published welder qualification program on WeldQ.
(f) Weld may cancel or change examination dates, venues or locations at its discretion and candidates will be notified by email.
(g) Candidates who sit online examinations will be remotely invigilated by a third party, Meazure Learning and consent to Meazure Learning’s Terms of Service (https://www.meazurelearning.com/terms-of-service) and Privacy Policy (https://www.meazurelearning.com/privacy-policy).
6.2. Examination Misconduct
(a) Cheating during an exam or results review will result in invalidation of the exam and the results and you will not receive a refund of your examination fee.
(b) Recording, copying, or use of external devices, screens or monitors during exams (unless authorised by Weld) is prohibited.
(c) If misconduct during multiple exams is confirmed by Weld, the candidate may be barred from Weld exams for at least five years, and any existing qualifications or certifications may be revoked.
(d) All examination work must be the candidate’s own and not copied from any other source or person.
6.3. Certification and use of diplomas
(a) Certification validity periods vary by type and are listed in the application form.
(b) Candidates must read and comply with the “Use and Misuse of Diplomas and Certificates” agreement, available in the Library section on WeldQ and provided as a link in the declaration when a candidate submits an application for certification.
7. Privacy
7.1. Weld’s obligations with regard to your privacy are set out in the GTCs.
7.2. Meazure Learning. Candidates who sit online examinations will be remotely invigilated by a third party, Meazure Learning through a Linked Site. You acknowledge that Meazure Learning will collect personal information about you for this purpose, including biometric data which is sensitive personal information and such information will be handled by Meazure Learning in accordance with its Privacy Policy (https://www.meazurelearning.com/privacy-policy).
8. User account and user conduct
8.1. User account. After you complete the user registration process at the Site, you will receive a user account name (WeldQ ID) to access the Site and will be required to set up a password. You are responsible for your access credentials as set out in the GTC.
8.2. User conduct. You are responsible for all content you upload, post or transmit through the Site. You must not use the Site to post unlawful, infringing, misleading, harmful or unsolicited material, advertise or offer to buy or sell goods or services except as expressly permitted, interfere with the Site, its security or other users, or attempt to gain unauthorised access to systems or data. You must comply with all applicable laws when using the Site.
9. Content
9.1. Use. All content made available by Weld on the Site (excluding user content and Linked Sites) is owned or controlled by Weld and may not be copied, reproduced or used without its prior written consent.
9.2. Monitoring. Weld does not generally monitor content but may remove or refuse any material at its discretion and may disclose content where required by law or necessary to protect its rights, users, or the public. You use all content on the Site at your own risk, and you acknowledge that the Site may involve transmissions over networks outside Weld’s control.
9.3. Storage and deletion. You acknowledge that Weld is not responsible for the deletion, loss or failure to store any content or communications on the Site. Weld may remove, modify, or delete any content or account information (including inactive accounts) at its discretion and may change its usage policies at any time.
9.4. Suspension. Weld may modify, suspend or discontinue access to the Site (or any part of it) at any time, temporarily or permanently, with or without notice and without liability. It may also terminate your account or access to the Site at its discretion, including for breach of the Contract, and may delete all related information. Upon termination, you must immediately stop using the Site, but termination does not affect any rights or liabilities that have already accrued.
10. Third parties
10.1. Any dealings between you and third parties found on or through the Site are solely between you and those parties. Weld is not responsible or liable for any loss or damage arising from such dealings or from the presence of third parties on the Site.
10.2. You acknowledge that if you sit an online examination, you will be remotely invigilated by a third party, Meazure Learning through a Linked Site and you consent to Meazure Learning’s Terms of Service (https://www.meazurelearning.com/terms-of-service) and Privacy Policy (https://www.meazurelearning.com/privacy-policy).
