CERTIFICATION SERVICES SCHEDULE
The following terms and conditions apply when Weld Australia ABN 63 003 696 526 (Weld) provides Certification Services to its customers (Customer, you).
The terms and conditions set out in this document (Certification Services Schedule) are in addition to Weld’s General Terms and Conditions available at https://weldaustralia.com.au/general-terms-and-conditions (GTC). If there is any inconsistency between the GTCs and this Certification Services Schedule, the latter prevail over the former to the extent necessary to resolve the inconsistency.
1. Definitions
1.1. All capitalised terms have the meaning given to them in the GTC unless otherwise defined in this document.
1.2. In this document, the following additional definitions apply:
(a) Certificate means the certificate issued by Weld in accordance with clause 2.1(c).
(b) Certification has the meaning given to that term in clause 2.1(c).
(c) Certification Audit means, for each Standard, the audit undertaken by Weld to assess your compliance with that Standard in accordance with the Rules of the Scheme.
(d) Certified Assessors means assessors who are issued an IIW MCS ISO 3834 Lead Assessor Certification by the Weld Australia Scheme Manager.
(e) Final Certification Audit Report means the report prepared by Weld following assessment of your response to any findings in the Initial Certification Audit Report.
(f) Initial Certification Audit Report means the report prepared by Weld following completion of the Certification Audit.
(g) Rules of the Scheme means, for each Standard, the rules developed and applied by Weld and approved by the relevant accreditation body, for assessing compliance with that Standard.
(h) Standard means each standard specified in the Order, being AS/NZS ISO 3834, AS/NZ 5131, EN 15085, DIN 2303.
(i) Surveillance Audit means, for each Standard for which you have received Certification, the annual audit undertaken by Weld to confirm your ongoing compliance with the Standard, where applicable as per the Rules of the Scheme.
(j) Surveillance Audit Report means the report prepared by Weld following completion of a Surveillance Audit.
2. Certification Services
2.1. Weld will supply the following Certification Services in respect of each Standard specified in the Order:
(a) conduct a Certification Audit to assess your compliance with the Standard in accordance with the Rules of the Scheme, including assessment of documents submitted by you and conduct of a site audit;
(b) report the Certification Audit results in an Initial Audit Certification Report and a Final Audit Certification Report, including notification of any non-compliance with the Standard;
(c) once Weld is satisfied that all findings identified in the Final Certification Audit Report have been satisfactorily addressed by you within the timeframe specified in the report, Weld will issue a certificate confirming your compliance with the Standard (Certification); and
(d) conduct annual Surveillance Audits to confirm your ongoing compliance with each Standard for which you have received Certification, where applicable as per the Rules of the Scheme.
3. Deliverables
3.1. For each Standard, Weld will supply the following Deliverables for the Certification Services:
(a) an Initial Certification Audit Report;
(b) a Final Certification Audit Report;
(c) a Certificate, provided you meet the requirements of clause 2.1(c);
(d) if you are successful in achieving Certification, your profile will be included on Weld’s website at https://iso3834.com.au/directory/; and
(e) a Surveillance Audit Report for each Surveillance Audit.
4. Audit process
4.1. The Certification Audit and each Surveillance Audit will be conducted by Certified Assessors.
4.2. Weld will notify you in writing of the nominated Certified Assessors (Assessment Team). You must notify Weld within 7 days if any nominated assessor is unacceptable. If any assessor is rejected, Weld will propose replacements, and the process in this clause will apply to them.
4.3. Once agreed, the Assessment Team will commence the relevant audit on the date agreed with Weld.
4.4. Each audit will include a site audit at the locations specified in the Order, at a time agreed with you. If you cancel or postpone the site visit less than 48 hours prior to the agreed audit date, a fee of $500 plus GST will be payable. Where travel costs are applicable, any cancellation or late change of date requested by you that results in additional booking fees and/or fare increase exceeding the quoted amount will be payable by you.
5. Customer responsibilities
5.1. To enable Weld to provide the Certification Services to you, you agree to:
(a) appoint a representative responsible for managing the assessment process;
(b) accept or reject the proposed Assessment Team within 7 days of notification;
(c) ensure relevant staff are available on audit days;
(d) allow the Assessment Team full access to premises, documents, records and relevant personnel (Weld will treat all documents, records and information received during the audit as your Confidential Information in accordance with the General Terms and Conditions); and
(e) provide safe and suitable office space for the Assessment Team during audits.
5.2. You warrant that all information you provide to Weld and the Assessment Team is complete, accurate, true and not misleading. You indemnify and hold harmless Weld and the Assessment Team from and against any liability, loss, damage, claim, cost, or expense arising directly or indirectly from any Certification issued in reliance on information you provide which is inaccurate, incomplete, false or misleading, including any Certification issued in error.
5.3. You are responsible for ensuring that any site accessed by Weld personnel and the Assessment Team is safe and complies with all applicable laws and regulations. Weld accepts no liability for injury, damage, or loss arising from unsafe site conditions or from factors beyond Weld’s control.
6. Certification conditions
6.1. Your Certification for each Standard is valid for the certification validity period as per the Rules of the Scheme from the date specified on your Certificate (Validity Period) and is conditional on the following:
(a) you must promptly notify Weld in writing of any changes to staff, facilities, or organisation that may affect your compliance with the applicable Standard and may be required to participate in an additional Surveillance Audit for which additional fees will apply as specified in the Order;
(b) you must participate in an annual Surveillance Audit and address all findings notified in the Surveillance Audit Report to the satisfaction of the Assessment Team as per the Rules of the Scheme, such rectification to occur within the period specified in the report or such other period agreed with Weld; a new Certificate will only be issued if there has been a change of details, scope or personnel since the last Certificate was issued;
(c) if there is a change in the Standard during the Validity Period, you will be notified in writing by Weld and you must ensure your compliance with the revised Standard at the next Surveillance Audit.
6.2. If you fail to meet any of the above conditions in respect to your Certification, Weld may provide you with written notice to rectify the breach. If you fail to rectify the breach within 14 days of written notice, Weld may, by further notice to you, suspend or cancel your Certification, in accordance with the Rules of the Scheme.
7. Payment Terms
7.1. Each milestone will be invoiced before commencing the related activities. You can withdraw from the Contract at any time without stating any reasons, provided that you pay all amounts due and payable for Services completed up to the date of termination.
7.2. You will not be entitled to a refund of any fees that are paid in advance, unless the Contract is terminated by you in accordance with the General Terms and Conditions for Weld’s default.
